The prosecution proceedings against the President can already start a single member of the House of Representatives. Prerequisite is the charge of treason, bribery or other "serious crimes and misconduct". At least one of the 435 deputies of the House of Representatives must bring the prosecution in the same way as a bill. The House of Representatives as a whole can also start a resolution of a resolution by means of a resolution. In the past, the applications for impeachment were initially lodged in the Judiciary Committee of the House of Representatives. This is to some extent initiating a kind of court ruling, which the Senate – the second chamber of the US Congress – has to decide. If two-thirds of Senate members conclude that the allegations against the President are justified, he must vacate his place in the White House. In this case, the Vice-President assumes the duties of the head of state until the next regular election date.
The 25th constitutional supplement
After the assassination of President John F. Kennedy in 1963, the Amending Resolution was supplemented by the 25th constitutional amendment in 1967. The successor question should be clarified in the event that the President is not in a position to govern. After the fourth section of the amendment, the Vice-President and a majority of the Cabinet or a body designated by the Congress may declare in writing that the President is incapable of performing the duties and duties of his office. If this declaration is handed over to the President of the Senate and House of Representatives, the Vice-President assumes the duties of the President.
Then, however, the president may object and inform the chairmen of the two congress chambers that there are no obstacles to the exercise of their duties. Within a four-day period, the Vice-President and a majority of the Cabinet or a majority of the body appointed by the Congress may reject this. Congress must then meet within 48 hours to decide the dispute. If two-thirds majority in the Senate and in the House of Representatives decide that the President is unable to govern, the Vice President takes over his office until the next regular presidential election. If no two-thirds majority is reached, the head of state remains in office.
Previous procedures
So far, no president has been removed from office as part of an impeachment of his office. Richard Nixon came in 1974 with his resignation in the course of the Watergate affair of an accusation. The House of Representatives took up the proceedings against two presidents – Bill Clinton (1998) and Andrew Johnson (1868), but the proceedings subsequently failed in the Senate. The fourth section of the 25th constitutional amendment has never been applied. The third section has already been used. It provides that a President may, in the event of illness or surgery, transfer his presidential power to a deputy for a limited period.
