Mobile phone at the wheel: Court confirms Apple's innocence of deadly car accidents

Many drivers use the smartphone while driving, which leads to accidents due to the distraction. A Californian court denied Apple's complicity in a case where a person was killed. The relatives saw at Apple a gross negligence because the company had taken no measures to protect the driver from distraction by his iPhone.

According to the judge of the Superior Court of California, County of Santa Clara, the causation of the plaintiff is too brittle. Ars Technica had published the preliminary ruling (PDF).
The other side argued that Apple had developed a technique to disable certain features of the smartphone automatically. Apple has even since 2014 a patent on such a technique. The company, however, refused to use this technology because of the fear of losing market shares.
Since IOS 11 was announced in June 2017, the statement that Apple is not concerned about driving safety, will hardly be able to maintain in the future. In iOS 11, a non-interfering feature is installed that prevents the driver from receiving incoming messages, calls, or hints from apps. The so-called do-not-distract function can be activated voluntarily: it automatically detects whether the iPhone is in the car and switches all notifications to mute. The display remains dark when a message is received.

Apple could not be alleged negligence, the judge continued. The undertaking is not required to impose any obligations on the applicant against the applicant.
Apple has already been sued more often, because drivers were distracted and then were crashed. A US District Court in Texas had already dropped a lawsuit against Apple. The family members of a five-year-old child had tried to sue Apple (PDF), because their five-year-old daughter lost her life in December 2014 with an Autounfall. A driver who collided with his parents' car had used Facetime during the ride.
An investigation by the German Automobile Club (AvD) has shown that 53 per cent of the interviewees have already posted messages during the trip and have even read 72 per cent of news.
