The divorce of a marriage by a Sharia court in Syria is not legally binding in the opinion of an important EU expert in Germany.

Since men and women do not have equal access to the religious divorce court, this right is discriminatory and does not apply in the European Union. This was announced by the competent Attorney General at the European Court of Justice, Saugmandsgaard Øe, on Thursday.

Judgment of the ECJ
It is about a couple from Syria, which has German nationality and lives in Germany. The two had married in 1999 in Syrian Homs. In 2013 the man had divorced himself before the spiritual court in Syria with a unilateral declaration.

In Germany, he applied for recognition of this decision. The President of the Oberlandesgericht in Munich gave this notice with reference to EU law. When the wife challenged the decision, the Munich court asked the ECJ for advice.

Experts Øe clearly rejected the recognition of the divorce. This has not yet come to a decision, but the ECJ often follows such conclusions.
